LATE TUESDAY UPDATE: WJBF has learned from the GBI via email that Justin Elmore, the man shot Sunday afternoon in Cherry Tree Crossing has died. Elmore died at MCG. His body will not go to the GBI Crime Lab for autopsy.
(Augusta) - GBI agent Gary Nicholson says there will be a thorough, impartial investigation into Sunday night's shooting at Cherry Tree Crossing.
Nicholson: “Our job is to look and see if there were any criminal laws broken and that is the focus of our investigation.”
Justin Elmore is in critical condition after he was shot by two deputies who patrol the housing development. The Sheriff says Elmore had drugs and weapons in his car. He says officers fired when Elmore turned his SUV into a weapon.
Two officers fired their guns and Nicholson says the cameras in their patrol car were rolling.
“We have looked at them, scrutinized them; looked at them in detail. We cannot release them. They have been entered as evidence in this case.”
Nicholson says he is not allowed to discuss details of the case. He says all the findings will be turned over to the District Attorneys’ office. It will up to the D.A. to decide where it goes from there. He says the tapes show the shooting in detail.
“The video is good quality and it accurately showed what happened. There are two cameras from two different perspectives.
A third camera in a patrol car in the rear also captured the shooting but there are problems with the tape and Nicholson says they are working to repair it.
Nicholson says the GBI’s job is to gather the facts and try to get to the truth about what happened. The agency is waiting on ballistic analysis from the officers guns. There has been speculation that during the shooting several bullets entered a nearby apartment.
Nicholson: “We did retrieve a couple of projectiles from one of the apartments and they have been sent to the lab for analysis.”
